Welcome to RealEstateInParkCity.com, operated by Derrik Carlson, doing business as REAL ESTATE IN PARK CITY, a licensed real estate agent with KW Park City Keller Williams Real Estate. These Terms of Service ("Terms") govern your access to and use of our website (the "Site"). By using the Site, you agree to these Terms. We may update them from time to time, and your continued use of the Site after we post changes constitutes acceptance.

1. Informational Purposes Only

This website provides general real estate information, market insights, property listings, and tools for Park City and Summit County, Utah. All content is for informational purposes only and does not constitute professional real estate, financial, legal, tax, or investment advice. Always consult a licensed professional before making any real estate or financial decision.

2. No Client Relationship Created

Using this Site does not create an agency, client, or fiduciary relationship. A real estate agency relationship is created only through a written buyer or seller representation agreement signed with a licensed agent. Browsing the Site, submitting a form, or contacting us does not, by itself, create any such relationship.

3. Accuracy of Information

We work to keep the Site accurate, but property details, prices, availability, and market data can change rapidly. All listings are subject to errors, omissions, change, or withdrawal without notice. You should verify all information independently. We are not responsible for actions taken based on Site content.

4. Prohibited Uses

When using the Site, you agree not to engage in any of the following:

  • Unauthorized scraping, data mining, harvesting, or copying of content

You may not reproduce, distribute, or display this content without our written permission. MLS and IDX listing content remains the property of its respective owners and is subject to their terms. If you submit content such as a review or testimonial, you grant us a non-exclusive, royalty-free license to use, display, and reproduce it in connection with our services.

6. Third-Party Links

The Site may contain links to external websites. We do not endorse or control them and are not responsible for their content, accuracy, or privacy practices.

7. Disclaimer of Warranties and Limitation of Liability

The Site is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. You agree to indemnify and hold harmless Derrik Carlson, REAL ESTATE IN PARK CITY, KW Park City Keller Williams Real Estate, and their affiliates from any third-party claims, damages, losses, or reasonable expenses arising from your use of the Site or your violation of these Terms, except to the extent such claims result from our own gross negligence or willful misconduct.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Site will be resolved in the state or federal courts located in Summit County, Utah, and you consent to the jurisdiction of those courts.

10. Privacy Policy

Our Privacy Policy is incorporated into these Terms by reference. Please review it for details on how we collect and use information and on your rights, including under the Utah Consumer Privacy Act and the California Consumer Privacy Act where applicable.

11. Modifications

We may modify, suspend, or discontinue any part of the Site at any time. We may also revise these Terms, and any updated version will be posted here with a new effective date.

You must be at least 18 years old to use the Site.
